Toronto Daycare Injuries Lawyers

When you leave your children with a daycare provider, you trust that your kids will be safe and well cared for. Unfortunately, even with the best daycare, accidents can happen. There have been many cases where children have suffered serious and life-altering injuries as a result of negligence or error on the part of a daycare facility. Daycare facilities have a responsibility to keep your children safe, and when they fail in this duty, you have the right to hold them financially accountable.

If your child has been hurt, injured, or has died as the result of daycare injuries, the caring and compassionate Toronto daycare injury lawyers from Mazin & Associates, PC are here to help. We can help you recover money to pay for medical expenses, rehabilitative costs, disability, pain and suffering, and more. Contact us today at (416) 625-2122 to discuss your legal options.

Why You Need a Daycare Injury Lawyer

If your child was severely injured under the supervision of a daycare, you have the right to pursue a lawsuit against the responsible parties. A dedicated lawyer can investigate the accident, the facility, and the staff to determine who is responsible for your child’s injuries. A lawyer can also interview witnesses and review the childcare centre’s policies and records to gather all the necessary evidence for your case. Daycare providers who do not provide the level of care and supervision required under the law may face strict penalties from the Ministry of Education.

When a child suffers an injury, the owners of the center and the staff providing care could be held liable and be obligated to pay compensation for your child’s accident. If the provider is found negligent, you could receive compensation for your child’s injury; past, present and future medical treatment and associated costs; therapy; and pain and suffering. If you attempt to handle your claim on your own, you are likely to receive far less money, if any, than you would with a lawyer’s help.

Daycare Injuries: Rules and Regulations

The rules surrounding day cares vary from province to province. Because there is a shortage of licensed daycares, all of Canada’s provinces and territories allow some unlicensed facilities to operate. Licensed daycares are subject to different inspections, regulations, and reviews.

Unlicensed daycares—which usually operate in someone’s private home—are not routinely inspected and do not need an annual review conducted by the Ministry of Education. This exemption leaves room for negligence or unsafe conditions in an unlicensed home. It is not possible for the government to monitor them unless there is a complaint filed by a parent or another individual.

No matter what type of daycare facility, the staff providers who care for children have a duty to protect them, care for them, and keep them safe. There are many reasons a child could suffer a debilitating injury, but the most common causes include:

  • Untrained or improperly trained staff
  • Lack of supervision or inappropriate supervision
  • Slip and fall accidents
  • Defective and dangerous playground equipment
  • Lack of medical knowledge on the part of the staff
  • Playing with harmful or unsafe toys
  • Unsanitary or hazardous conditions

If your child was injured while at daycare, Mazin & Associates, PC can help you hold the daycare staff financially accountable.
